Terms of Service

The agreement between you and Wisteria for using Wisteria. We have written it to be read, and put a plain-English summary at the top of every section that has one worth having.

Please read this first

These terms describe version 1 of Wisteria at launch. The app has not launched yet. We are publishing the terms in advance so that they can be read before anyone signs up. We will update them as the product ships, and we will change the “last updated” date and give notice in the app when we do.

The agreement

In plain English

Using Wisteria means agreeing to these terms, to our Privacy Policy and to our Community Guidelines. If you do not agree with them, please do not use the app.

These Terms of Service (“Terms”) are an agreement between you and Wisteria (“Wisteria”, “we”, “us”), a company registered in the United States at [Wisteria registered address]. They govern your access to and use of the Wisteria mobile applications for iOS and Android, this website, and any related services we provide (together, the “Service”).

By creating an account or using the Service you accept these Terms. Our Privacy Policy and Community Guidelines form part of this agreement. Where the Guidelines and these Terms overlap, both apply; where they conflict, these Terms govern.

Who may use Wisteria

You must be 18 or older. There are no exceptions, and we do not care how close to 18 you are.

  1. You must be at least 18 years old. Wisteria is an adult community platform. It is not directed at minors, and no one under 18 may create an account, use the Service, or appear in content on it.
  2. We verify age using the age-assurance signals Apple and Google provide, together with the date of birth you give us at signup. Giving a false date of birth is a breach of these Terms and grounds for immediate termination.
  3. You must not be barred from using the Service under the laws of the country you are in, and you must not have been removed from Wisteria before.
  4. Membership is open. You do not need to belong to a club, and you do not need to verify your identity, to hold an account. Verification is optional. We do not claim that members have been vetted or screened — because they have not been. You are responsible for your own judgement about who you interact with, on the platform and off it.

Your account

In plain English

Your phone number is your account. There is no password. Keep control of your phone number, because whoever can receive your codes can reach your account.

  1. Authentication is by phone number and one-time passcode. Wisteria has no passwords. You sign in by entering a code sent by text message to your number.
  2. You are responsible for your phone number and the device that receives those codes. If you change or give up your phone number, change it in the app first — a recycled number can otherwise be used to reach an account. Tell us at support@wisteriasocial.com immediately if you think someone else has access to your account.
  3. One account per person. Do not create an account for anyone else, do not share your account, and do not create a new account to evade a suspension or a block.
  4. You can see every device signed in to your account and end any of those sessions from inside the app.
  5. Standard message and data rates from your carrier may apply to the text messages we send.

Subscription and billing

$15 a month, billed by Apple or Google, never by us. It unlocks the feed, discovery and messaging — nothing else is behind it, and there is nothing else to buy. Cancel any time through the store you bought it from; we cannot cancel it for you.

What the subscription is

  1. Wisteria Community costs $15 per month. One tier, one price. It unlocks the feed (Home), discovery (Explore) and messaging.
  2. Browsing clubs and events, and getting tickets, is free to every member whether or not they subscribe.
  3. There are no engagement paywalls. No paid likes, no message limits, no boosts, no paid extras you have to keep buying, no ads, and no advantage that can be bought. Every filter is included. We will not degrade the experience to extract more money from you.
  4. Paying never unlocks mature content. Mature content is gated by verification and only by verification — see the content policy.

How billing works

  1. Subscriptions are sold and billed only through the Apple App Store and Google Play. There is no web checkout for a Wisteria subscription anywhere, and we will never ask you for card details for one. If a site or a message asks you to pay Wisteria for a subscription outside the app stores, it is not us.
  2. Your subscription is charged by the store to the payment method on your Apple ID or Google account, under that store’s terms. Prices shown may exclude taxes the store adds.
  3. A short introductory trial may be offered. If you do not cancel before the trial ends, the subscription begins and is charged. A trial gives access; a failed payment does not.
  4. Subscriptions renew automatically at the end of each monthly period until you cancel.
  5. Only one active subscription per member is possible, regardless of which store it came from. A store receipt binds to the first Wisteria account that redeems it and cannot be moved to another account afterwards.

Cancelling and refunds

  1. Cancel through the store you bought it from — Apple App Store subscription settings, or Google Play subscription settings. We cannot cancel a store subscription for you, because we do not control store billing. Support has step-by-step instructions.
  2. Cancelling stops the next renewal. Access continues to the end of the period you have already paid for.
  3. Refunds are handled by Apple and Google under their own policies, not by us. If you believe you were charged in error, contact the store first; if you tell us at support@wisteriasocial.com we will help you make the request, but we cannot issue a store refund ourselves.
  4. Deleting your Wisteria account does not cancel a store subscription. Cancel it at the store as well.

Partner seats

A member may cover the subscription of one person they hold an accepted relationship with, at a reduced rate. The partner-seat price is [not yet set — founder decision] and will be shown in the app before you buy. If the relationship ends, the covered person’s access runs to the end of the period already paid for and does not renew, and the buyer’s plan returns to a single seat. Nobody can hold covered seats from two people at the same time.

Price changes

If we change the subscription price, we will give notice in the app and through the store before it takes effect, and you will have the opportunity to cancel before being charged the new amount. Where the store requires your explicit consent to a price increase, no increase will be charged without it.

Your content

In plain English

What you post stays yours. You give us only the permission we need to actually show it to the people you chose — nothing wider, and nothing that survives you deleting it, except where someone else is genuinely part of it.

  1. You keep ownership of everything you post — your photos, your posts, your comments, your messages, your profile.
  2. You give us a licence to run the Service. You grant Wisteria a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, transmit and display your content solely to operate, secure and support the Service and to show that content to the people your own visibility settings permit. This licence exists so we can put your photo on your profile and deliver your message to its recipient. It gives us no right to publish, syndicate, license or use your content for marketing, and we do not.
  3. The licence ends when the content does. When you delete a post or delete your account, the licence ends, other than for the copies described in the Privacy Policy — the parts of a shared conversation or a shared event record that belong to someone else, and anything we must retain for safety or legal reasons.
  4. You promise you have the right to post it. You must own or be licensed to use everything you upload, and everyone appearing in a photo you upload must be an adult who has agreed to appear in it.
  5. We may remove content that breaches these Terms, the Community Guidelines, or the law, and we may refuse a photo that the automatic check rejects under the content policy.
  6. Feedback you send us — suggestions, bug reports, ideas — we may use without obligation or payment.

The content policy

In plain English

No nudity on a public profile photo, ever. Swimwear, lingerie and costume are fine everywhere. Nudity is permitted only in direct messages, only between verified adults, and only where you have chosen to see it — it is off in the feed at launch. Payment never unlocks any of this.

  1. Public profile photos may never contain nudity or sexual activity. This rule has no exception ever and does not change with verification or subscription.
  2. Ordinary adult content is permitted everywhere. Clothed, swimwear, lingerie and costume photography is ordinary content on Wisteria. It is never blurred and never restricted.
  3. Mature content is limited to direct messages at launch. Content above that ordinary threshold is rejected at upload on the feed, in comments and on profiles. If we ever allow it somewhere else in the app we will say so publicly, update these Terms, and update our store listings first.
  4. Mature content in direct messages requires verification on both sides. Only verified members — ID-verified or club-verified — can send or view it. It is blurred by default and takes two deliberate actions to reveal.
  5. Verification, not payment, is the gate. A subscriber who has not verified sees no mature content. Wisteria does not sell access to adult material, and never will.
  6. Illegal content of any kind is prohibited without exception. Content sexualising minors is reported to the authorities and preserved as the law requires. There is no warning, no appeal window, and no second account.
  7. Photos are checked automatically. Images shared in direct messages are checked on your device where the platform supports it.

Acceptable use

In plain English

Do not harass people, do not lie about who you are, do not send explicit content to people who did not ask for it, do not out anybody, and do not use this place to sell things. The full, human version is in the Community Guidelines.

You agree not to:

  • Harass, threaten, stalk, intimidate, defame or abuse anyone, or encourage anyone else to.
  • Send sexually explicit content to anyone who has not agreed to receive it.
  • Misrepresent who you are — including a single person presenting as a couple, using someone else’s photos, or claiming a verification, a club membership or a relationship you do not have.
  • Post content depicting anyone under 18, or anyone who has not consented to appear.
  • Disclose another member’s identity, participation in this community, relationships, health status or attendance at an event, to anyone, without their explicit permission.
  • Save, screenshot, copy, repost or redistribute another member’s photos or messages outside Wisteria.
  • Use the Service for commercial solicitation — advertising, escort or sex-work solicitation, promotion of other platforms, recruitment, multi-level marketing, or selling anything, including tickets.
  • Buy, sell, transfer or resell tickets, accounts, or access of any kind.
  • Post hate speech, or content attacking people on the basis of race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation or relationship structure.
  • Scrape, crawl, harvest or bulk-collect content, images or member information by any means, automated or manual.
  • Reverse engineer, decompile, interfere with, overload, probe or attempt to gain unauthorised access to the Service.
  • Use bots, scripts or automation to interact with the Service.
  • Circumvent a block, a suspension, a report outcome, or any safety control.
  • Do anything unlawful, or use Wisteria to arrange anything unlawful.

Your safety off the platform is your own to manage. Wisteria does not screen members, does not conduct background checks, and does not supervise anything that happens between people away from the app. Meet people with the care you would use anywhere else.

Relationships and shared cards

In plain English

A shared card only exists while everyone in it currently agrees. Any one of you can withdraw at any moment, and the card is gone — without ending the relationship, and without anyone being told whose switch moved.

  1. Relationships on Wisteria are mutually accepted. Whether someone is named on your profile requires both your willingness to name them and their permission to be named. The permission always wins.
  2. A shared card representing a couple or a larger grouping is discoverable only while every current member of it consents. Any member may withdraw that consent at any time, for any reason or none. Withdrawal takes effect on the next read.
  3. You may not create or maintain a shared card representing someone who has not agreed to it, and you may not pressure, coerce or trick anyone into consenting. Doing so is a serious breach of these Terms.
  4. Unfollowing, disconnecting and blocking are three separate, escalating actions. Disconnecting is irreversible by design — it closes the relationship, both follows and the conversation at once, so that nobody is left connected through a door they believed they had shut. Rebuilding it means genuinely starting again. We cannot restore a disconnection for you.
  5. Ending a relationship does not delete the history that existed. Group cards are archived rather than deleted so that moderation history survives.

Clubs, events and tickets

Clubs are independent businesses. When you buy a ticket or apply for membership, your agreement is with the club, not with us. We never touch the money and we cannot refund a ticket.

  1. Clubs on Wisteria are independent third parties. We do not own, operate, control or supervise them, their venues, their staff, or their events, and we do not endorse them.
  2. Wisteria is not a party to any ticket or membership transaction. The club sets prices, capacity and terms; the club takes payment through its own payment processor; the club issues the ticket and admits or refuses entry. Your contract for a ticket or a membership is with the club.
  3. We never touch club money. Payment goes from your device to the club’s processor. We do not collect, hold, or pay out club funds, and we do not receive your card details.
  4. Refunds, cancellations, entry disputes and event changes are matters for the club. Contact the club. We are happy to help you find the right person, but we cannot refund a ticket or overturn a door decision.
  5. Membership applications go to the club. When you apply inside the app you are completing the club’s own form and your answers go directly to them. We never see or store what you put in it. Approval and denial are entirely the club’s decision.
  6. Only clubs sell tickets. There is no member-to-member resale, transfer or marketplace of any kind, and attempting one is a breach of these Terms.
  7. A club may have its own rules, dress code and conduct standards. Follow them. A club barring you from its premises is the club’s decision and does not by itself close your Wisteria account — it opens a case a person at Wisteria reviews.

Reporting and enforcement

In plain English

You can report anything, anywhere. A person reads it, within 24 hours. An automated flag never bans anyone on its own.

  1. Report and block are available everywhere in the app — profiles, posts, comments, photos, messages and chat requests.
  2. We commit to a 24-hour response time from report to resolution, with real people on it every day.
  3. Reports are reviewed by people. Our automated integrity checks flag patterns for human review; they never issue an automated ban.
  4. Depending on what we find we may remove content, restrict a feature, suspend an account, or terminate it. We aim to match the response to the behaviour, and we take repeat behaviour into account.
  5. Report outcomes are silent by default: we do not tell the person you reported that it was you.
  6. If you believe we got it wrong, tell us. Write to support@wisteriasocial.com and a person who did not make the original decision will look at it again.
  7. Deliberately false or malicious reports are themselves a breach of these Terms.

Ending this agreement

In plain English

You can leave whenever you like, from inside the app, without asking us and without explaining yourself. We can close an account that breaks these rules or puts other members at risk — and wherever it is safe to do so, we will tell you why.

  2. We may suspend or terminate an account that breaches these Terms or the Community Guidelines, that we reasonably believe presents a risk to other members, or where we are required to by law. Where it is safe and lawful to do so, we will tell you why.
  3. Serious breaches — content sexualising minors, credible threats of violence, non-consensual sharing of intimate images, or deliberate exposure of another member’s identity — result in immediate termination without notice.
  4. We may discontinue the Service, or any part of it. If we discontinue it entirely, we will give reasonable notice, stop billing, and provide a way to export your data.
  5. The sections on content licence, disclaimers, limitation of liability, indemnity and governing law survive the end of this agreement.

Our intellectual property

The Wisteria name, logo, app, website, design, and all software and content we create are owned by Wisteria and protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal, non-commercial use, in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service, or use our name or branding without written permission.

If you believe content on Wisteria infringes your copyright, write to legal@wisteriasocial.com with enough detail to identify the work and the content, your contact details, and a statement that you have a good-faith belief the use is not authorised. We respond to valid notices under the Digital Millennium Copyright Act and will remove infringing content.

Third-party services

The Service depends on third parties: Apple and Google for distribution, billing and age signals; our cloud host; our text-message provider; our messaging transport; our content classification providers; and, if you choose to verify, an identity verification provider. Their handling of your information is described in our Privacy Policy and governed by their own terms.

Apple and Google are not parties to this agreement and have no responsibility for the Service. Where a store’s own terms require particular provisions to apply to your use of an app downloaded from it, those provisions apply in addition to these Terms.

Disclaimers

In plain English

Wisteria is a place to meet people, not a guarantee about them. We do not vet members, and we cannot promise the service will never be down or never get anything wrong. Nothing here takes away rights your local consumer law gives you.

We build this carefully, but we cannot promise the app is perfect or that everyone on it is honest. Verification is optional, most members will not have it, and a badge is not a guarantee about a person.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Wisteria disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against every attack, or that any defect will be corrected.

We do not vet members. Membership is open, and most members will not be verified. Identity verification and club verification are optional markers that mean exactly what they say — that a document check passed, or that a club confirmed a membership — and nothing more. They are not a character reference, a background check, or a safety guarantee. We are not responsible for the conduct of any member, on or off the platform, and we do not supervise or control interactions between members or events run by clubs.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

If something goes wrong, there is a cap on what we can be made to pay — the greater of what you paid us in the past year or $100. That is standard, and it does not cover fraud or personal injury caused by us, which can never be capped.

To the fullest extent permitted by law, Wisteria and its officers, members, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service — including any conduct of another member, any content posted by anyone, any event run by a club, any unauthorised access to your account, or any interruption of the Service.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars ($100.00).

Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

If you break these rules and somebody sues us over what you did, you cover our costs. This applies only to your own actions — never to something we got wrong.

You agree to indemnify and hold harmless Wisteria and its officers, members, employees and agents from any claim, demand, loss or expense (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms or the Community Guidelines, or your violation of anyone else’s rights. We will notify you of any such claim and may take over its defence at our own cost.

Governing law and disputes

US law applies, and disputes are heard in one named court. If you live in the EU or the UK, your own country’s consumer rights still apply. And please write to us first — almost everything is easier to fix that way.

These Terms are governed by the laws of [State], United States, without regard to its conflict-of-laws rules. The courts located in [County, State] have exclusive jurisdiction over any dispute arising out of these Terms, and you and we each consent to that jurisdiction — except that either of us may seek injunctive relief in any court of competent jurisdiction.

If you are a consumer resident in the EU, the UK, or another jurisdiction whose law gives you the right to bring proceedings in your own country’s courts or to rely on your own country’s consumer protection law, nothing here takes that right away.

Before filing anything, please write to us at legal@wisteriasocial.com. Most disputes are a misunderstanding that a conversation resolves, and we would rather have the conversation.

Changes to these terms

We may update these Terms as the product changes or as the law requires. When we make a material change we will update the “last updated” date, give notice in the app before it takes effect, and — where the change materially reduces your rights — ask you to accept it. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, delete your account.

General

  • Entire agreement. These Terms, the Privacy Policy and the Community Guidelines are the whole agreement between you and us about the Service.
  • Severability. If any provision is found unenforceable, the rest remains in force.
  • No waiver. If we do not enforce a provision, that is not a waiver of it.
  • Assignment. You may not assign these Terms. We may assign them to an affiliate or a successor in a merger or acquisition.
  • No third-party beneficiaries, other than as stated in Third-party services.
  • Language. These Terms are written in English, and the English version governs.
